KNOW ALL men, trade and custom that we,The Board of Control for Cricket in India, having our office at 2nd floor, Cricket Centre, Wankhede Stadium, ‘D’ Road, Churchgate, Mumbai 400 020, are the proprietors of the trade mark IPL, IPLT20, INDIAN PREMIER LEAGUE, CLT20 and other trade marks containing the above expressions and derivative and variants thereof (“the said trade marks”).
We are the registered proprietors of the trade mark IPLin India under No.1760385 in class 09 and under No.1656216 in classes 16, 18, 22, 25, 28, 32, 35, 37, 39, 41 and 43. We are the registered proprietors of the trade mark INDIAN PREMIER LEAGUEin India under No.1760384 in class 09 and No. 1656213 in classes 16, 18, 22, 25, 28, 32, 35, 37, 39, 41 and 43. We are the registered proprietors of the trade mark CLT20in India under No.1760380 in class 09 and No. 1736612 in classes 16, 18, 22, 25, 28, 32, 35, 37, 39, 41 and 43.We are also the registered proprietors of the said trade marks in various foreign countries such as Singapore, Hong Kong, European Union, Kenya, Malaysia, New Zealand and UAE. We are openly, extensively and regularly using the said trade marks since 2007 and have acquired immense reputation and goodwill therein. Consequently the said trade marks are exclusively associated with us and with none else. We are therefore entitled to the exclusive use of the said trade marks.
We have recently come to know that some person(s) and/or company have illegally registered and are trying to sell/transfer various domain names containing the trade marks IPL,INDIAN PREMIER LEAGUE, CLT20 and IPLT20thereby misrepresenting to the public and inducing consumers to believe that they/ their domain names are connected/ associated with us. Please take notice that any unauthorized use (including in the form of a domain name) of a trade mark identical with and/or deceptively similar to our trade marks IPL, INDIAN PREMIER LEAGUE, CLT20 and IPLT20and other trade marks containing the above expressions and derivatives and variants thereof tantamounts to inter-alia falsification and infringement of our registered trade mark/s as also “passing off” and would invite criminal prosecution, seizure of the goods bearing the false trade mark/s and civil action for injunction and damages, under the provisions of the Trade Marks Act, 1999. Further, please take note that the said persons do not have any right, title or interest in the said domain names in order to effect a valid transfer/sale thereof.
The public is hereby warned not to deal with and/or purchase/ transfer such domain names containing the trade marks IPL, INDIAN PREMIER LEAGUE, CLT20and IPLT20 from/ to any other person/ entity other than us.
